Effective 10/01/09, Florida now requires parents who wish to relocate with or from their children to comply with many requirements before they move.
Relocation is defined as a move of:
- Greater than 50 miles
- From principal residence of a child
- At time of last order establishing or modifying timesharing
- Change of primary residence of child for 60 or more consecutive days
Florida law places severe penalties on parents who relocate without following the procedures, set forth in the statute. Contempt, loss of physical custody and imposition of attorney's fees and costs are just some of the penalties that can be ordered.
