A major issue to be resolved upon divorce is alimony or spousal support. Alimony may be paid from one spouse for support of the other spouse after a divorce or during a separation.
Alimony is based on several factors - the need of the recipient spouse, the ability of the recipient spouse to earn income, the ability of the payer spouse to pay, the length of the marriage, and the lifestyle that the parties were accustomed. Fault of the divorce may also be considered under certain circumstances.
There are many different types of alimony depending on the length of the marriage and other circumstances. Alimony is based on the needs of the receiving spouse and the ability of the other spouse to pay. Both must be proven in order for alimony to be awarded.
Although most alimony payments are made from the husband to the wife, in instances where the husband stays home and takes care of the home and children, the wife may be required to pay alimony.
