Foreclosure for property owners and private lenders
If you are a borrower whose property is threatened with foreclosure, we can negotiate a lender workout agreement or loan modification. If you are facing foreclosure, we can prepare and lead your legal defense, arrange for a homestead foreclosure conciliation conference, and assist in settlement negotiations.
If you are a private lender who holds a mortgage secured by property and the borrower defaults, we can also assist you. Our firm will negotiate with the borrowers as required and, in the case of a default, use the proper legal procedures to enforce the security interest in the property.
Evictions and landlord-tenant dispute
Both landlords and the tenant (renter) have rights. This includes rentals for apartments, residential homes, businesses, mobile homes, and mobile home parks. Landlords and tenants also have obligations which are part of an oral or written agreement. Though a written agreement is always best, some oral agreements may hold up in court in a landlord-tenant dispute.
We represent landlords or tenants in property with non-compliance issues and related evictions. Our goal is to reach an agreement acceptable to both parties so the property itself does not suffer.
In cases of evictions, the law provides that a tenant may remain in a foreclosed property for 30 days after the purchaser delivers written notice to the tenant. It happens that sometimes renters are completely unaware that their residence is in foreclosure until they are presented with an eviction notice and the demand to vacate the premises. We can represent either side of an eviction with the goal of reaching the best outcome possible for our client and the property.
